I have uploaded through www.thebemagugu.com/heirloom a photograph to use on the Thebe Magugu Heirloom Shirt. I own the copyright in and to the photograph;
I have a licence from the owner of the copyright to make use of, reproduce and/or adapt the photograph and to sublicense others to do so.
I warrant that the use, reproduction and/or adaptation of the photograph by Thebe Magugu (Pty) Ltd and does not amount to infringement of any third-party rights.
I hereby indemnify and hold Thebe Magugu (Pty) Ltd harmless against any claims, damages, loss and/or costs that may arise from the use, reproduction and/or adaptation of the photograph.
I hereby agree that Thebe Magugu (Pty) Ltd will not be liable for any special, punitive or consequential damages, loss or injury, however caused, arising from any claim relating to the use, reproduction and/or adaptation of the photograph. This applies even if Thebe Magugu (Pty) Ltd is aware that such damages, loss or injury are possible.
I hereby waive any moral rights that may vest in me in respect of the photograph.
I accept that Thebe Magugu may conduct their own search on copyright and decline your order of the Heirloom Shirt if the submitted image in question is copyright protected by another party. I have the ability to contest by providing written proof of said protected copyright, stating that its usage is granted by me.
I accept that deliveries for the Heirloom Shirt Project will proceed to ship from the 10th of December 2023 onwards.
Due to the custom nature of the Heirloom Shirt, I accept that all refunds are prohibited and only returns for the purpose of resizing shall be considered. I accept that returns for the purpose of resizing shall only be accepted within 15 days from the date the Thebe Magugu Heirloom Shirt is delivered.
By accepting these Terms & Conditions & Purchasing the Thebe Magugu Heirloom Shirt, I agree to be bound by them.
